It didn’t need to be, since it’s not distributed in the repository, but it is. There’s no other copyright in the code. (I checked yesterday.)

I absolutely think this action was wrong from an ethical standpoint, but legally, it looks like they can do it. Premium plugin devs need to check the code of their paid versions and make sure they haven’t made the oversight ACF/WP Engine did in leaving the GPL terms in the Pro version.
